1. Who you are contracting with
Flowverly is provided by Harnord Inc, a Virginia corporation (“we”, “us”). By creating an account or using the service you agree to these terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind it.
2. What the service does
Flowverly answers inbound calls, text messages and web chats for your business using an automated assistant, and can book appointments into a calendar you connect. It is configured by you: your hours, your services, your prices, your escalation number.
It is an automated system and it will sometimes be wrong. It can mishear, misunderstand, or fail to book. You are responsible for reviewing the bookings and transcripts it produces, and for having a fallback for calls it escalates or cannot handle.
3. Your responsibilities
- Give us accurate information about your business, including the legal entity details required to register phone numbers and messaging on your behalf.
- Only use the service to communicate with people who have a genuine relationship with your business or have asked to hear from you.
- Configure and use call recording lawfully where you and your callers are located, including obtaining consent where required.
- Keep your login credentials secure and tell us promptly if they are lost.
4. Messaging compliance
Text messaging in the United States is governed by carrier and industry rules (including 10DLC registration) and by law (including the TCPA). We register the messaging identity on your behalf, honour STOP and HELP automatically, and block messages to anyone who has opted out.
You remain responsible for who you message and why. We do not permit the service to be used for unsolicited marketing, and we may suspend an account that generates complaints or violates carrier rules — sometimes without notice, because carrier action against us affects every customer. This allocation of responsibility should be reviewed by counsel.
5. Prohibited uses
You may not use Flowverly to:
- Send unsolicited marketing, or messages to people who have opted out.
- Impersonate another business or person.
- Handle emergency, medical-triage or crisis calls as a substitute for a human or an emergency service. Flowverly is not an emergency service.
- Break the law, or the rules of the carriers who deliver our traffic.
6. Your data
You own your business data and the conversations your callers have with your receptionist. We process them to run the service, as described in our Privacy Policy. We do not sell it, and we do not use conversation content to train models.
On request we will export your data in a usable format. On account closure we delete it, except where we are required to retain billing and audit records — the periods are listed in the Privacy Policy.
7. Fees
Fees are as published or as set out in your order. Usage-based charges are metered and billed in arrears. We may change prices with reasonable notice; if you do not accept a change you may cancel before it takes effect.
8. Availability
We aim for high availability and we build for it, but we do not currently offer a contractual uptime guarantee, and we will not pretend otherwise. The service depends on third parties — telephony carriers and model providers — whose outages we cannot prevent. Keep call forwarding you can fall back to.
9. Termination
You can cancel at any time; the cancellation takes effect at the end of the current billing period. We may suspend or terminate an account for non-payment, for a breach of these terms, or where continuing would put our carrier relationships at risk. Where practical we will tell you first.
10. Disclaimers and liability
The service is provided “as is”. To the extent the law allows, we disclaim implied warranties of merchantability and fitness for a particular purpose.
We are not liable for indirect or consequential loss, including lost profits or lost business, arising from missed, mishandled or misrouted communications. Our total liability in any twelve-month period is limited to the fees you paid us in that period. This section has not been reviewed by counsel and the cap is a placeholder.
11. Changes to these terms
We may update these terms. If a change is material we will notify account holders and update the date at the top. Continuing to use the service after a change means you accept it.
12. Governing law and contact
These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules.
